1. Agreement to these terms
These Terms and Conditions (“Terms”) are an agreement between Company Name (“Company,” “we,” “us,” or “our”) and the person or organization accessing AI Stylist. By installing, accessing, or using AI Stylist or this website, you agree to these Terms. If you use AI Stylist for a business, you represent that you can bind that business.
2. The service
AI Stylist is a Shopify application that can provide conversational product discovery, outfit matching, visual analysis, and generated product visualizations. Features may vary by plan, merchant configuration, provider availability, location, or product stage.
We may improve, change, suspend, or discontinue features. We will use reasonable efforts to avoid material disruption, but we do not promise uninterrupted or error-free operation.
3. Accounts and access
Merchants must maintain an eligible Shopify account and protect access credentials. You are responsible for activities under your account and for providing accurate setup, billing, and contact information. Notify us promptly if you suspect unauthorized access.
4. Merchant responsibilities
Merchants control how AI Stylist is presented on their storefront and are responsible for:
- The legality, accuracy, pricing, availability, and descriptions of their products.
- Required notices, consents, and policies for shoppers using the app.
- Reviewing app settings and outputs before relying on them for business decisions.
- Complying with Shopify’s terms and all applicable consumer, privacy, advertising, and accessibility laws.
5. Acceptable use
You may not use AI Stylist to violate law or third-party rights; process content without appropriate permission; generate abusive, deceptive, exploitative, or illegal material; probe or disrupt the service; bypass security or usage limits; reverse engineer the service except where law permits; or use automated means that unreasonably burden the service.
We may limit or suspend access when reasonably necessary to prevent harm, address security threats, comply with law, or investigate a material violation of these Terms.
6. Content and permissions
You retain ownership of content you provide. You grant us and our service providers a limited right to host, copy, transmit, modify, and process that content only as needed to operate, secure, and improve the service. You represent that you have the rights and permissions needed to provide it.
The Company and its licensors retain all rights in AI Stylist, including its software, design, documentation, and branding. These Terms provide a right to use the service, not ownership of it.
7. AI-generated outputs
AI outputs are generated probabilistically and may be incomplete, inaccurate, or unsuitable. Visualizations are illustrative and may not precisely represent fit, color, texture, dimensions, or real-world appearance. AI Stylist does not provide medical, legal, financial, or other professional advice.
Merchants and shoppers should use independent judgment and verify important information. We do not guarantee that an output is unique or that similar output will not be provided to another user.
8. Plans, fees, and cancellation
Paid plans, usage allowances, trial terms, and charges are shown through Shopify or within the app before purchase. Shopify processes applicable billing. Recurring charges continue until cancellation according to the displayed billing terms. Fees are non-refundable except where required by law or expressly stated otherwise.
9. Privacy
Our Privacy Policy explains how we handle information. By using the service, you acknowledge those practices. Merchants remain responsible for their own customer-facing privacy obligations.
10. Disclaimers
To the maximum extent permitted by law, AI Stylist is provided “as is” and “as available.” We disclaim implied warranties, including merchantability, fitness for a particular purpose, non-infringement, and warranties arising from course of dealing. Nothing in these Terms excludes rights that cannot lawfully be excluded.
11. Limitation of liability
To the maximum extent permitted by law, Company Name and its suppliers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, data, goodwill, or business opportunities arising from the service.
To the maximum extent permitted by law, our total liability for claims relating to the service will not exceed the amount you paid for AI Stylist during the six months before the event giving rise to the claim. This limitation does not apply where prohibited by law.
12. Termination
You may stop using AI Stylist and uninstall it through Shopify. We may terminate or suspend access for a material breach, nonpayment, legal requirement, security risk, or discontinuation of the service. Provisions that by their nature should survive termination will remain in effect.
13. Governing law
These Terms will be governed by the laws applicable where Company Name is established, without regard to conflict-of-law principles. The required governing jurisdiction and dispute venue must be added before publication. Mandatory consumer protections remain unaffected.
14. Changes to these terms
We may update these Terms. We will post the revised version and update its effective date. If a change materially affects existing paid use, we will provide notice where reasonably required.
